Tiana Zaebst, attorney with HensonFuerst, publishes in Lawyers Weekly

An article by attorney Tiana H. Zaebst was published in the May 10, 2010, issue of North Carolina Lawyers Weekly. The topic: How people who have been permanently injured in an accident often overlook a valuable source of long-term protection.

According to Ms. Zaebst, people who have been injured in an accident can benefit from Social Security disability benefits, regardless of whether they have collected money from an injury lawsuit or settlement. Social Security Disability Income (SSDI) can provide income until retirement age, and also provide Medicare medical benefits. Why is this important?  By the time a lawsuit is heard in court, an injured person could have been disabled and out of work for several years. And, according to Ms. Zaebst:

Winner of the 2010 HensonFuerst PSA Content Announced

Congratulations to Terrell G., student at Douglas Byrd High School in Fayetteville, North Carolina! He was named the grand-prize winner of the 2010 HensonFuerst PSA Contest.  His winning video elegantly blended creative vision and savvy editing skills, giving life to a message of bicycle safety.

The prize is pretty wonderful: a new Apple MacBook with video editing capability (or $1500.00 electronics gift certificate)… and a $500 donation to the student’s school. Terrell’s PSA will be aired on local television and on the HensonFuerst website.

Two runners-up were also named:  Frank B. of Sanderson High School, and Jordan A. of Durham School of the Arts.

The competition this year was serious–18 entries by talented high school students from eastern North Carolina. We’re proud of all the entrants, and we hope this contest helps to encourage their creative endeavors.

Teen Driving Safety Emergency

There have been so many teen driving deaths in the past week that the names are starting to run together. The faces, however, are unique… and haunting. The eyes are full of optimism, intelligence, and promise, their youth seems fresh and endless, and in and instant it all disappeared–no more optimism…no more promise…no more youth.

It is beginning to feel like an epidemic of tragedy.

According to and article on the WRAL website, four central and eastern NC high school students have died in the past week. In addition:

In the past four years, 682 teenagers have been killed in wrecks investigated by state Highway Patrol. Johnston County, in particular, has struggled with a highest rate of teen driving deaths. Nearly 40 teenagers have died there in the past five years – three so far this year, nine in 2009 and seven in 2008. (WRAL, 5/2/2010)

URGENT RECALL: Infant & Children’s Liquid Medications

McNeil Consumer Healthcare has issued a voluntary recall of all of its over-the-counter liquid infant’s and children’s Tylenol, Motrin, Zyrtec, and Benadryl. While the company has said that no one has been injured, there is the potential for serious injury. Stop using these products IMMEDIATELY.

The company reports that some products may contain “a higher concentration of active ingredient than is specified”  (dangerous!), inactive ingredients that don’t “meet internal testing requirements,” and possibly particle contaminants. They don’t say what those contaminants might be, but another pharmaceutical company (Hospira) had to halt production of two drugs due to machinery residue that got into the products. Nothing like tiny bits of stainless steel to make a person feel better….

According to the McNeil recall notice (available here: McNeil recall notice):

The company is conducting a comprehensive quality assessment across its manufacturing operations and has identified corrective actions that will be implemented before new manufacturing is initiated at the plant where the recalled products were made.

Consumers can contact the company at 1-888-222-6036 and also at www.mcneilproductrecall.com. Parents and caregivers who are not sure about alternative pediatric health treatment options should talk to their doctor or pharmacist and are reminded to never give drug products to infants and children that are not intended for those age groups as this could result in serious harm.

The U.S. Food and Drug Administration (FDA) has an FAQ page devoted to this recall: FDA info for parents. Two of the most important questions and answers from that site:

  • I gave my child some of the medication. What do I do? Is my child at risk?

According to the information the FDA has received at this time, the potential for serious medical problems is remote. If your child exhibits any unexpected symptoms after use of any of the recalled products, contact your healthcare provider.

  • If I think my child may be having an adverse reaction to one of the products involved in this recall, who should I notify?

Adverse reactions or quality problems experienced with the use of these products may be reported to FDA’s MedWatch Adverse Event Reporting program either online, by regular mail, or by fax, using the contact information at the bottom of this sheet. The agency asks health care professionals and consumers to report any adverse reactions to the FDA’s MedWatch Program by fax at 1-800-FDA-0178, by mail at MedWatch, FDA, 5600 Fishers Lane, Rockville, MD 20852-9787, or on the MedWatch website at www.fda.gov/medwatch.

Join Oprah’s NO PHONE ZONE

HensonFuerst Attorneys support Oprah’s No Phone Zone–a pledge to help end distracted driving by committing to drive as responsibly as possible. This means:

1) NO TEXTING while driving, which is illegal in North Carolina anyway. As of December 1, 2009, it is unlawful to text while operating a vehicle, or to send or receive email.

2) Avoid using the phone while driving. It is illegal for all school bus drivers and all people under age 18 to use cell phone while operating a vehicle–no cell phone use at all.

3) If you must use a cell phone (and you are not under 18), safety guidelines suggest pulling over to the side of the road, OR use only a hands-free device.

Remember that when you use a cell phone, your brain becomes distracted. So even if you have both hands on the wheel, you may run into situations where your reaction time is slowed (or you make poor driving decisions) because you are using the phone.

Two Raleigh emergency vehicles collide

Two Raleigh emergency vehicles collided on their way to the scene of a North Carolina shooting.

According to NewsObserver.com, the Raleigh emergency vehicles crashed into each other at Creech Road and Slippery Elm Drive. The drivers of each emergency vehicle were taken to WakeMed in Raleigh and treated for minor injuries.

The Raleigh shooting victim was also taken to WakeMed with a gunshot wound to his leg.

Something Good from the Toyota Debacle?

in 2004, Toyota launched a new advertising campaign: Toyota–Moving Forward. Since Toyota has implemented recall after recall to address problems with sudden and uncontrollable acceleration from sticking gas pedals, people have begun joking that the motto should should be changed to:  Toyota–Moving Forward, and We Just Can’t Stop.

It has been frightening to watch Toyota’s freefall from paragon of safety to…well, no one really knows how deep the pit they’ve dug really is. For consumers, the single bright point is that these events and the Congressional hearings that have taken place over the last two weeks may lead to new safety rules.

According to an Associated Press article:

We need to look at current law and ask if it is strong enough to prevent something like this from happening again,” said Sen. Jay Rockefeller, D-W.Va., chairman of the Senate Committee on Commerce, Science and Transportation, which held a hearing Tuesday on Toyota.

In addition:

Transportation Secretary Ray LaHood told the committee Tuesday that his agency may recommend that every new vehicle sold in the United States be equipped with the brakes, something that would require a relatively inexpensive software upgrade.
