Your Defective Product Claim

Statute of Limitations and Repose

When making a defective product claim in North Carolina, there are two time limits you need to be aware of:

  • Statute of limitations

    To meet the state’s statute of limitations, you must file a personal injury claim within three years from the date of injury or within two years for cases involving death.
  • Statute of repose

    In North Carolina, you generally must file or resolve a defective product claim within 12 years from the date of manufacture or sale of the product unless it involves real estate, in which case, it is six years from the date of manufacture or sale. This is known as the statute of repose.
