When an elevator company emptied hydraulic fluid into several empty detergent drums while performing maintenance at one of the hospitals, the barrels were confused with sterilization detergent. For almost 2 months instruments were washed with a solution of hot water and hydraulic fluid, and the problem was discovered only after hospital staff and surgeons noticed their operating tools were slick and oily. As a result of being operated on with surgical instruments contaminated with waste hydraulic fluid, certain patients experienced symptoms such as post-operative infection and long term auto-immune disorders.
Arising out of that incident, Henson Fuerst recently resolved, without resort to litigation, all claims against Duke University Health Systems and its constituent hospitals. Specific terms are confidential based on mutual agreement by both parties. Henson Fuerst preserved their rights to proceed with claims against other defendants in this incident, which included Cardinal Health and Steris Corporation.
