North Carolina Wrongful Death Lawsuit Filed in Response to Fatal I-85 Crash

When a person’s death is the result of negligence, the family of the victim may have a right to compensation. In order to file a successful North Carolina wrongful death lawsuit, an attorney must present evidence to prove who was at fault for the incident.

A recent report highlights negligence that led to the death of a University of North Carolina at Chapel Hill student in a fatal car accident on I-85 in July. According to WRAL News, the crash happened in Orange County when the 20-year-old student merged onto the interstate going the wrong direction while under the influence of drugs and alcohol. He then collided with a vehicle, killing her and two others.

A daughter of one of the victims filed a lawsuit against the driver and his father last week, claiming that the 20-year-old student’s choice to drive drunk was intentional and negligent. Furthermore, she claims the student’s father is also liable in the accident since he owned the vehicle involved in the crash and willfully let his son drive it.

The victim’s daughter is seeking $25,000 in compensatory damages and an undisclosed amount of punitive damages in the case.

This case shows just how complicated proving negligence can be. That’s why the North Carolina wrongful death attorneys at HensonFuerst are hopeful a decision will bring a sense closure to the family of the victim.
