  • Seatback failure
  • Glazing of windshields
  • Heavy trucks

Defective Airbags

If you ever find yourself involved in a serious car accident, an airbag could end up saving your life. Unfortunately, some airbag devices may be defective, or could fail to deploy properly in the event of a crash. Defective Airbags can cause devastating injuries, and even death.

In 2015, several major auto manufacturers launched what was referred to at the time as “the largest auto recall ever” due to defective airbags that were causing serious injuries. When deployed, these defective airbags were known to explode, sending dangerous shrapnel and debris into the face of the driver. Several motorists were seriously, and even fatally, injured by these defective airbags.

If airbags fail to deploy in the event of an accident, the resulting injuries can be just as devastating. Every airbag device comes equipped with a computer module designed to detect a sudden decrease in speed caused by a car accident. If this device is does not function properly the airbag could fail to deploy, leaving the driver at risk of suffering severe head or brain injuries.

Common airbag malfunctions include:

  • Failure to deploy
  • Failure to deploy at moderate speeds
  • Deploying with too much force
  • Deploying without impact

If you or a loved one suffered serious injuries caused by a defective or malfunctioning airbag device, you may be entitled to compensation for your injuries. The North Carolina product liability lawyers at Henson Fuerst have extensive experience advocating for the rights of people that were injured by defective or unsafe products.

Defective Door Latch Mechanisms

Many vehicles have been recalled because their doors do not latch properly when closed. Whether locked or unlocked, car doors are designed to keep all passengers safely within the vehicle at all times. If these mechanisms are not properly designed, they can seriously endanger the safety of both drivers and passengers.

Defective Door Latch mechanisms can cause a vehicle’s doors to fly open unexpectedly. If this happens when a car is in motion, or in the event of an accident, passengers may be ejected from the vehicle and suffer devastating injuries.

If you or a loved one suffered serious injuries due to a defective door latch mechanism, call Henson Fuerst right away at (919) 781-1107 or fill out a free consultation form online. Fuel-Fed Fires

If the structural integrity of vehicle’s fuel tank has been compromised, it can pose an enormous safety risk to motorists. If the metal frame surrounding the fuel tank, or any of the hoses and filters attached to the tank, were improperly installed or maintained, they may begin to leak. Fuel tank leakage can allow oil or gasoline to come into direct contact with electrical equipment, leading to extremely dangerous fuel-fed fires.

Fuel-fed fires pose a major safety risk to vehicle owners, and thousands of cars have been recalled due to this dangerous product defect. If you or a loved one suffered severe burns or any other serious injuries due to a fuel-fed fire, call Henson Fuerst right away at (919) 781-1107 or fill out a free consultation form online.

Your injuries may have been caused by a dangerous product defect, or due to the negligence of an auto manufacturer. Rollover Accidents

Rollover accidents are a particularly dangerous type of car crash that are more likely to result in driver fatalities. According to the Insurance Information Institute, Rollover Accidents accounted for 35% of all driver fatalities in 2010.

Certain types of vehicles, including larger SUVs and vans, may be more prone to rollover accidents because they have a higher center of gravity than other passenger vehicles. However, any type of vehicle may rollover during an accident depending on driver behavior, road conditions, as well as other factors.

Roadway defects such as slick roads, soft shoulders or potholes could be a contributing factor that lead to Rollover Accidents. These accidents could also be due to car defects or improper safety testing on the part of auto manufacturers.

Roof Crush Accidents

In the event of a Rollover Accident, it is critical that a car’s roof is able to support the full weight of the vehicle. Car safety organizations like the Insurance Institute for Highway Safety conduct extensive testing to ensure that a vehicle’s roof is structurally sound and can maintain occupant survival space in the event of a Rollover Accident.

When a vehicle’s roof collapses during a rollover accident, it can cause devastating injuries.

Roof Crush could be the result of a defective vehicle design or a manufacturing error. If you or a loved one suffered serious injuries in an accident due to Roof Crush, you may be entitled to financial compensation.

Tire Blowouts

When drivers experience a sudden and unexpected loss of air pressure in their tires, it can cause serious car accidents and devastating injuries. Tire blowouts cause thousands of driver injuries every year, and may be the result of a dangerous product defect.

A tire blowout occurs when a rapid loss of air pressure causes the rubber tire to flex beyond its elastic limits and separate from the inner lining of the tire. When this occurs, it can cause drivers to lose control of their vehicle.

Common causes for tire blowouts include:

  • Underinflation
  • Defective tires
  • Potholes and other Roadway Defects
  • Overloading your vehicle
  • Age

If you or a loved one were involved in a car accident caused by a tire blowout, it could be the result of a Car Defect or a Roadway Defect. Call Henson Fuerst right away at (919) 781-1107 or complete an initial consultation form online for a free, no-obligation consultation about your case.

Seat Belt Failure

In 2014, nearly half of all fatal car accidents involved at least one driver that was not wearing their seat belt at the time of the crash. Seatbelts save lives, but unfortunately, these safety devices do not always function properly. If you or a loved one suffered injuries caused by a defective seat belt, you may be entitled to compensation.

In order for a seat belt to function properly in the event of a crash, it must keep the driver and passengers firmly in place. This greatly reduces the risk of serious injury during a car accident. One of the most important devices in a seat belt is called the pretensioner.

The pretensioner causes the belt to tighten and remove any slack in the event of a sudden deceleration. If the pretensioner is defective, it can render the seat belt effectively useless and lead to serious injuries.

Other causes of seat belt failure may include:

  • Defective latch mechanisms that cause the seat belt to detach during a crash
  • Seat belt tears or becomes detached from the mount
  • Improperly designed or installed shoulder harness

Seat belt failure can lead to devastating injuries for motorists. If you or a loved one were injured by a defective product, call Henson Fuerst today at (919) 781-1107 or complete an initial consultation form online.

Seat Back Failure

Seat Back failure is a dangerous product defect that can cause severe and even fatal injuries for drivers and passengers.

Seat Back Failure occurs when a vehicle’s driver or passenger seats collapse during an accident. Seat Back Failure is most common in accidents where a vehicle is hit from behind, and can result in occupants being launched into the back seat

In March of 2016, a jury in Texas awarded $124.5 million to a family that experienced the devastating consequences of Seat Back Failure. In this case, an eleven-year-old was permanently injured when his father was launched into the back seat of his car after an accident. The boy’s family successfully sued carmaker Audi for damages. The jury in this case sited the auto manufacturer’s “gross negligence” in failing to identify and correct this defect as a determining factor in the case.

If you or a loved one suffered serious injuries due to Seat Back Failure, or due to any other type of Car or Product Defect, Henson Fuerst may be able to help. Call Henson Fuerst today at (919) 781-1107 or complete an initial consultation form online for a free consultation about your case.

Windshield Glazing

Since 1968, the Federal Motor Carrier Safety Administration (FMCSA) has required that all cars be manufactured using glazing material in all windshields, as well as side and rear windows. Windshield glazing is a laminated material that designed to prevent glass shards from breaking apart in the event of a crash.

Windshields are generally constructed using 4 to 5 mm thick sheets of either tempered safety glass (TSG) or laminated safety glass (LSG). Glazing material helps reduce serious injuries caused by broken glass, and minimizes the possibility of occupants being ejected through the windows or windshield during a crash.

If a car’s windshield and side and rear windows were not built using this safety glazing material, or if the glazing material used was defective, it can result in serious personal injuries, including:

  • Traumatic Brain Injury
  • Spinal Cord Injury
  • Amputations
  • Severe cuts and lacerations
  • And more
